Terms of Service

Welcome to Annacati (the “App”), a public transit information application operated by DI STASO DAVIDE, an Italian sole proprietorship (ditta individuale), with registered address at Via San Giovanni 121, 98057 Milazzo, Italy (“we”, “us”, or “our”).

By downloading, accessing, or using the App, you agree to these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use the App.

1. About the App

Annacati provides public transportation information, including scheduled and real-time transit data relating to buses, trains, airport connections, and related transport services.

The App is intended for informational purposes only and is provided free of charge.

Some transit information displayed in the App is sourced from third-party data providers and public transport feeds, including but not limited to:

• FlixBus GTFS and realtime feeds

• Public GTFS feeds published by transit agencies

• Publicly available rail timetable datasets

We do not operate transportation services ourselves.

2. Eligibility

The App is available to users of all ages. If you are under the age required to consent to digital services in your country, you should use the App under the supervision of a parent or legal guardian.

3. Licence to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes in accordance with these Terms.

You may not:

• Copy, modify, distribute, sell, or lease any part of the App

• Reverse engineer or attempt to extract the source code of the App, except where permitted by applicable law

• Use the App in any unlawful manner

• Interfere with the operation or security of the App

All intellectual property rights relating to the App remain our property or the property of our licensors.

4. Transit Data and Accuracy

The App relies on third-party transit data sources that may contain errors, delays, interruptions, inaccuracies, or outdated information.

We do not guarantee:

• The accuracy or completeness of schedules or realtime information

• That any vehicle will arrive or depart at the displayed time

• The availability of any route or transport service

• Continuous or uninterrupted operation of the App

Transit conditions may change without notice due to traffic, weather, strikes, technical failures, operational decisions by transport operators, or other factors outside our control.

You are responsible for independently verifying critical travel information where necessary.

5. No Transportation Service

Annacati is an informational platform only. We do not provide transportation services, ticketing services, journey guarantees, or travel insurance.

Any transportation services referenced in the App are operated by independent third parties. Your use of those services may be subject to separate terms and conditions imposed by the relevant transport operators.

6. Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for:

• Missed buses, trains, flights, or connections

• Delays, cancellations, or service interruptions

• Inaccurate transit information

• Loss of profits, revenue, data, goodwill, or business opportunities

• Indirect, incidental, special, consequential, or punitive damages

• Any damages arising from reliance on information displayed in the App

Nothing in these Terms excludes or limits liability that cannot legally be excluded under applicable law, including liability for fraud, fraudulent misrepresentation, or wilful misconduct.

7. Availability and Changes

We may modify, suspend, discontinue, or restrict access to all or part of the App at any time, with or without notice.

We may also introduce new features, remove existing features, or change supported transport providers.

We are not obligated to maintain the App or any specific functionality.

8. Future Features

The App may in the future include optional features such as:

• User accounts

• Saved favourites

• Feedback submission

• Personalised services

• Notifications

If these features are introduced, additional terms or updated policies may apply.

9. Privacy

Your use of the App is also governed by our Privacy Policy.

At present, the App does not collect personal data directly from users. Future changes to data processing practices will be described in an updated Privacy Policy.

10. Third-Party Services and Links

The App may contain references or links to third-party services, transport operators, or websites.

We do not control and are not responsible for:

• Third-party content

• Third-party availability

• Third-party privacy practices

• Third-party terms or policies

Your interactions with third parties are solely between you and the relevant provider.

11. App Store Terms

If you download the App through the Apple App Store or Google Play Store, you acknowledge that:

• Apple and Google are not parties to these Terms

• Apple and Google have no obligation to provide maintenance or support for the App

• Your use of the App must comply with applicable store terms and policies

You also acknowledge that the relevant app store provider may enforce these Terms as a third-party beneficiary where applicable.

12. Open Source Software

The App may include or rely upon open-source software components subject to their own licences. Where required, applicable open-source notices and licence texts will be made available within the App or upon request.

13. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Italy, excluding conflict-of-law principles.

Any disputes arising from or relating to these Terms or the App shall be subject to the jurisdiction of the competent courts of Italy, unless otherwise required by mandatory consumer protection law.

14. Changes to These Terms

We may update these Terms from time to time.

Updated versions will be published through the App, our website, or the relevant app store listing. Continued use of the App after changes become effective constitutes acceptance of the updated Terms.
